official evidence of what you did as president can't be introduced even in a case involving unofficial personal conduct, so if it has anything to do with what you are doing as president, he should not be put in because it would be too prejudicial for the jury to even hear it. they could not really be fair. that is the reasoning, that if they just heard what you did as president, it would incite their sort of emotions about the case too much for a jury to actually be fair, even when you are dealing with somebody who is the former president, about personal conduct. that is the craziness of why we are here and there are lots of arguments the d.a. makes that are very strong, some of which are that the issues here were not preserved. in other words, in order to have this claim, you have to make a claim at the time. the second is that this, even a supreme court case is not really talking about evidence of this case that is official. this is really unofficial so we are talking about a really small amount of the thing you are just referring to is what is called harmless error, meaning that this is a grain of

sand on the beach, that the results would've been the same. i'm going to give you up prediction that judge merchan on december 6 is going to say the convictions stand. there are just too many different good arguments made by the d.a. today as to why this is sufficient and we may find ourselves on september 18th, which the judge said is the date he may in fact go ahead and sentence defendant trump, the republican nominee for president. >> i will be in the courtroom. just to give the audience an understanding of harmless error, it would be in the range of the witness who testified that federal express envelops arrive at the white house through a certain route outside of the white house and that is how these checks would be brought into the president. you could theoretically say that needs to be excluded based on the new supreme court opinion because you're describing a white house process

. the judge could look at that and say okay, we might exclude that because it is a white house process, but because we did not excluded, it is an absolutely harmless error, that description of the fedex through the white house had nothing to do with the jury's verdict. >> you know when this usually comes up, when i used to do mark cases the defendant would say an appeal, i should've been able to cross examine the underboss and a witness on yet another bad act, and the court would say wait, you crossed him on 19 murders, you know, this is not going to change anything to a jury, so the idea of harmless error is that this is something that if you took it out of the case, the court is still convinced that the jury would have reached the same
